These Terms and Conditions set out the basis on which Waste Clearance Battersea provides waste collection, rubbish removal and related services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Company, we, us, our means Waste Clearance Battersea, the provider of waste collection and clearance services.
1.2 Customer, you, your means the individual or business that requests or uses our services.
1.3 Services means any waste collection, rubbish removal, disposal, clearance, loading, labour or related services provided by us.
1.4 Premises means the address or location where the Services are to be carried out.
1.5 Waste means the items, materials, goods or rubbish that you ask us to remove and which we agree to collect.
2.1 We provide waste collection and clearance services to domestic and commercial customers. Our services include collection, loading, removal and transport of Waste for lawful disposal or recycling.
2.2 We will only collect Waste that we are lawfully permitted to handle under applicable waste management and environmental regulations. Certain items are restricted or prohibited and may not be removed.
2.3 We do not provide building, demolition, plumbing, electrical or structural services. Any minor dismantling of items is solely for the purpose of removal and is not a separate service.
2.4 Our obligation is to provide the Services with reasonable care and skill, within the agreed time window, subject to circumstances outside our reasonable control.
3.1 Bookings may be made by telephone, email or through any booking system we make available. A booking is an offer by you to purchase Services in accordance with these Terms and Conditions.
3.2 We may request details including your name, contact information, service address, description of Waste, access information and preferred date and time window.
3.3 Your booking is only confirmed when we explicitly accept it and provide you with confirmation, which may be given verbally, in writing or through a booking system. We reserve the right to refuse any booking at our discretion.
3.4 Any quotation given at the time of booking is based on the information you provide. If the information is inaccurate or incomplete, we reserve the right to amend or withdraw the quotation and to revise the price.
3.5 We may offer estimated arrival times or time windows. These are not guaranteed and may be affected by traffic, weather, delays at previous jobs or other factors beyond our control. We will use reasonable efforts to keep you informed of any significant delay.
4.1 Prices are generally based on factors including volume, weight, type of Waste, labour required, access conditions and any additional services requested.
4.2 Unless we expressly state otherwise, all prices are given exclusive of any applicable VAT or other taxes, which will be charged at the prevailing rate where applicable.
4.3 Site assessments or photographs may be requested in order to provide a more accurate quotation. Any estimate given without an on-site inspection is indicative only and may change when we attend the Premises.
4.4 If the actual Waste, access, parking or other conditions differ materially from those described when you booked, we may adjust the price to reflect the additional time, labour, disposal charges or other costs incurred.
4.5 If you do not accept a revised price, you may cancel the Service before it starts. In such circumstances, we reserve the right to charge a reasonable call-out or cancellation fee to cover our costs.
5.1 Unless agreed otherwise in writing, payment is due in full upon completion of the Services on the day of collection.
5.2 We accept the payment methods that we notify to you at the time of booking or at the time of service, which may include cash, debit card, credit card or bank transfer.
5.3 Where we agree to provide Services on account to business customers, invoices are payable within the payment terms stated on the invoice. If no terms are stated, payment is due within 14 days of the invoice date.
5.4 If you fail to pay any amount due, we may charge interest on the overdue amount at the statutory rate from the due date until payment is received in full. We may also suspend or refuse further Services until all outstanding sums are settled.
5.5 You are responsible for ensuring that you are authorised to use the payment method provided and that all payment details are correct.
6.1 You may cancel or amend your booking by contacting us as soon as possible before the scheduled collection time.
6.2 If you cancel more than 24 hours before the agreed arrival window, no cancellation fee will usually be charged, unless we have incurred specific costs that cannot reasonably be recovered.
6.3 If you cancel within 24 hours of the agreed arrival window, or if we cannot carry out the Services due to your act or omission, we may charge a reasonable cancellation or call-out fee to cover our costs, including travel, staff time and administration.
6.4 If you are not present at the Premises at the agreed time, if access is not available, or if the Waste is not ready for collection, we may treat this as a late cancellation and charge a cancellation fee.
6.5 We reserve the right to cancel or reschedule the Services at any time due to circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, safety concerns or regulatory issues. Where possible, we will offer an alternative date or time.
7.1 You must ensure that you have full authority to request removal of the Waste and to grant us access to the Premises. If you are not the owner or occupier, you must have the consent of the person who is.
7.2 You must provide clear and safe access to the Premises and to the Waste. This includes ensuring that driveways, corridors, stairways and access routes are free of obstruction and reasonably safe for our team and vehicle.
7.3 You must inform us in advance of any parking restrictions, height restrictions, gate codes, limited access, or other issues that may affect our ability to carry out the Services.
7.4 You are responsible for ensuring that the Waste to be collected is clearly identified and that no items are removed by mistake. Our team may ask you to confirm the items to be taken before loading.
7.5 You must not include in the Waste any items that are prohibited under these Terms, under environmental law, or which you have not disclosed to us, including hazardous or specialist materials.
8.1 Certain types of Waste are subject to special controls and disposal requirements. These may include hazardous materials such as chemicals, solvents, oils, asbestos, clinical waste, certain electrical equipment and other regulated substances.
8.2 We may not be licensed or equipped to handle all forms of hazardous or specialist Waste. It is your responsibility to inform us in advance of any such items so that we can confirm whether we can lawfully and safely collect them.
8.3 If we discover prohibited or undisclosed hazardous materials within the Waste, we may refuse to collect them, or we may suspend the Service and charge for any costs incurred, including any additional disposal or safety measures required.
8.4 We may, at our sole discretion, refuse to handle any item that we reasonably believe poses a risk to health and safety, may cause damage to property or vehicles, or cannot be lawfully transported or disposed of.
9.1 Our team will attend the Premises within the agreed time window where reasonably possible. Time is not of the essence unless we have expressly agreed in writing to a specific time as an essential condition.
9.2 The team will load the Waste into our vehicle and, where reasonably practicable, will take reasonable care to avoid damage to your property. However, you should move or protect any fragile or valuable items in the vicinity of the work area.
9.3 We do not undertake to clean the Premises after the removal of Waste beyond a basic tidy of the immediate work area. Full deep cleaning or decontamination is not included in the Services.
9.4 Once the Waste has been loaded into our vehicle, it becomes our responsibility and will be transported for lawful disposal or recycling at an authorised facility.
10.1 We operate in accordance with applicable UK waste management and environmental legislation and regulations. We will only use licensed and authorised facilities for the treatment, recycling or disposal of Waste.
10.2 Where required, we will complete appropriate documentation such as waste transfer notes or consignment notes. You agree to provide any information reasonably required to complete such documents accurately.
10.3 You warrant that the Waste presented for collection is your own to dispose of and that it does not include stolen goods, unlawfully obtained items or materials that cannot be legally transferred.
10.4 If we incur any fines, penalties, costs or liabilities as a result of your breach of waste regulations or misdescription of Waste, you agree to indemnify us for such losses, provided that we act reasonably and lawfully in handling the Waste.
11.1 Nothing in these Terms and Conditions limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
11.2 Subject to clause 11.1, we shall not be liable for any indirect, consequential or special loss, or for loss of profit, business, revenue, contracts, anticipated savings, or goodwill, whether arising in contract, tort, negligence or otherwise.
11.3 Our total liability to you for any loss, damage or claim arising out of or in connection with the Services shall be limited to the total price paid or payable for the specific Service in respect of which the claim arises, unless otherwise required by law.
11.4 We shall not be liable for any damage to property arising from inherent defects, weakness or pre-existing conditions, including worn carpets, loose tiles, poorly secured fixtures or unstable structures.
11.5 We shall not be liable for any loss or damage resulting from your failure to comply with these Terms and Conditions, including failure to provide accurate information, safe access or proper identification of Waste.
12.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, resolve the issue.
12.2 Any claim for loss or damage to property must be notified to us in writing within 7 days of the date of the Service. You must provide reasonable evidence of the loss or damage and allow us access to inspect the alleged damage.
12.3 We may, at our discretion and without admission of liability, offer a remedy such as repair, replacement or a partial refund, taking into account the circumstances of the case.
13.1 We will process any personal information you provide in accordance with applicable data protection laws. This includes using your details to manage bookings, perform the Services, handle payments, and communicate with you.
13.2 We may retain records of bookings, invoices and related information for a reasonable period in order to comply with legal, tax and insurance obligations.
13.3 We will take reasonable steps to keep your personal information secure and will not sell it to third parties. We may share it with trusted partners where necessary to provide the Services or where required by law.
14.1 We shall not be in breach of these Terms and Conditions, nor liable for delay or failure in performing our obligations, if such delay or failure results from events, circumstances or causes beyond our reasonable control.
14.2 Such events may include, but are not limited to, extreme weather, natural disasters, accidents, vehicle breakdown, road closures, industrial action, acts of terrorism, war, or changes in law or regulation affecting the provision of the Services.
15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, applicable laws or business requirements.
15.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking, unless changes are required by law or you agree to the revised terms in writing.
16.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the remaining provisions.
16.2 If any invalid, unlawful or unenforceable provision would be valid, lawful and enforceable if some part of it were deleted or modified, the provision shall apply with the minimum modification necessary to make it valid, lawful and enforceable.
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
